BMC owns or operates several interactive websites, mobile applications, and other online interactive features and services (collectively, the “Sites”), and this Policy describes the types of information we may collect from you or that you may provide when you visit a Site and our practices for using, maintaining, protecting, and disclosing that information. Data We Collect About You, and How We Collect It

Listed below are the types of Personal Data that we may have collected about you within the past 12 months. Each type of information listed below is Personal Data only if it identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked by BMC, directly or indirectly, to you or your household.

  • Identifiers such as: your name, username, password, NPI, OE number, license number, Digital ID and photograph (if you or another user posts a photo on a Site).
  • “Customer Records” information (some of which may be identifiers or professional/employment-related information as well), such as your name, address, email address, telephone number, and date of birth; event-related information such as which meetings, courses, webinars, or other online events you may have attended; questions, ratings, and applications used, as well as any views and opinions that you choose to send to us, or publicly post about us on social media platforms or in the Sites, including on forums.
  • Commercial information, such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies, areas or topics of interest;
  • Geolocation data, which is data that describes the precise geographic location of the device through which you connect to a Site;
  • Internet or other similar network activity, such as browsing history, search history, information on your interaction with our website, mobile application(s), or an advertisement. This may include hardware and browser information of your computer or other online device.
  • Sensory data, such as audio, electronic, visual, or similar information. For example, if you chose to post or upload videos or photos to one or more Sites. 
  • Professional or employment-related information, such as your current or past job history, if you are applying for a job with us or for purposes of establishing your creditworthiness.
  • Personal characteristics related to classifications legally protected from discrimination, such as marital status, age and gender.
  • Inferences drawn from other Personal Data, such as a summary we might make based on your apparent personal preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities and aptitudes.

How We Collect Your Personal Data

We may collect your Personal Data in a number of ways, including:

  • Directly from you when you provide it to us. You may give us your Personal Data by filling in forms, or by corresponding with us by post, email or otherwise. For example, you may provide us with Personal Data when you:

    • post or publish material (such as contributions) on the Site (“User Contributions”);
    • request information or services;
    • report a problem with the Site;

For example, we may receive contact details, bank account details and details about payments to and from you and other details of products and services you have purchased from us from providers of technical, payment and delivery services.

    We also may collect information about your online activities over time, which may consist of, for example, your IP address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our Sites. Third Party Use of Cookies and Other Tracking Technologies

  • Among our subsidiaries and affiliates. We may disclose your Personal Data to our subsidiaries and affiliates, including those that may be located outside the jurisdiction where you reside, in accordance with applicable law.
  • To service providers

    • Advertisers/Agencies - we may disclose your personal engagement data to partner advertisers/agencies to measure and improve the user experience with relevant content and/or advertising.
    • Application Provider Services - we may disclose your Personal Data to application service providers located in the United States to provide us with services such as event specific applications, and to store information.
    • Cloud services - we may disclose your Personal Data to cloud service provider(s) located in the United States in order to store, back up and recover data.
    • Customer Relationship Management services - we may disclose your Personal Data to customer relationship management services located in the United States to store information, manage service activities and information across the group.
    • Email Service Providers - we may disclose your Personal Data to email service providers located in the United States to provide us with email marketing services, online behavioral tracking, to store information, and reporting.
    • Geo-Location Services - we may disclose your Personal Data to geo-location service providers located in the United States to provide us with services such as geo-targeting site content.
    • IT services - we may disclose your Personal Data to IT service providers located in the United States to provide us with services such as website hosting.
    • Market Research Services - we may disclose your Personal Data to market research service providers located in the United States to provide us with services such as surveys/questionnaires.
    • Payment Processing Services - we may disclose your Personal Data to payment service providers located in the United States to provide us with services such as secure payment processing, and to store information.
    • Registration Services - we may disclose your Personal Data to registration service providers located in the United States to provide us with services such as data collection, and payment processing.
  • As part of corporate reorganizations. We may disclose your Personal Data to a potential or actual buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Bryn Mawr Communications LLC's assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Data held by us is among the assets transferred.
  • To Other Third Parties

    • Contractors - we may disclose your Personal Data to contractors located in the United States to (i) provide us with product and/or advertising implementations or (ii) market their products or services to you.
    • Third-Party Advertisers - Some content on our Sites may require you to provide Personal Data to a third party in order to access the content. You will be notified of this requirement before accessing such content so you can choose whether to provide your Personal Data in order to access the content. We do not control third parties' collection or use of your information to serve interest-based advertising, but certain third parties may provide you with ways to choose to not have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI's website.
    • Other Site Users - Any Personal Data that you post and transmit to others shall be done at your own risk. Although we limit access to certain contributions to registered users of our Sites, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Site users with whom you may choose to share your Personal Data.
    • DMD Healthcare Communications Network Participation Disclosure - BMC is a member of the DMD Healthcare Communications Network (the "HCN"). HCN is owned and managed by DMD Marketing Corp ("DMD") and is designed to enable DMD and HCN members to provide medically relevant business communications to authenticated health care professionals. Your registration on a Site includes registration with HCN. As a result, your contact and other professionally relevant information will be disclosed to DMD and each HCN member to provide you medically relevant content as described in the HCN privacy policy available at https://HCN.health/privacy-policy/. The HCN privacy policy provides details on how to manage your information, including opting out of participation in the HCN. To the extent that this Policy conflicts with the HCN privacy policy, with respect to the use of this information by HCN, the conflict will be resolved in favor of the HCN policy.
  • For Legal Reasons. We may disclose your Personal Data:

    • To comply with any court order, law or legal process, including to respond to any government or regulatory request.
    • To enforce or apply the Site's Terms and Conditions and other agreements between us and you, including for billing and collection purposes.
    • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of BMC, our users or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Data Retention and Security

We retain your Personal Data only for as long as is necessary for our relationship with you, in accordance with our retention policies, and in accordance with applicable laws. We do not collect more Personal Data than we need to fulfil our purposes stated in this Policy, and we will not retain it for longer than is necessary.

We have put in place reasonable security measures to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your Personal Data to those employees, agents and service providers who need to know that information in order to provide services to us and yourself.

Children's Information

The Site is not intended for children under 13 years of age. If we learn we have collected or received Personal Data from a child under 13, without verifiable parental consent, we will delete that information. For Site Visitors in Europe

If you reside in the European Economic Area ("EEA") or the United Kingdom ("UK"), you have the following rights under data protection laws in relation to your Personal Data:

  • Request access to your Personal Data. This enables you to receive a copy of the Personal Data we hold about you and to check that we are lawfully processing it.
  • Request correction of your Personal Data. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

For California Residents

We will post any revised version of this Policy on the Sites, with note at the end indicating the date of the latest revisions.
